That picture will not do. Ifthe painter were to cease painting, what he has made up to that point would remain in existence, whereas it is precisely the ability to stand on its own that the doctrine of continuous creation seeks to deny of what is made. Nor does anything in the relation of artisan to artifact properly convey the special intimacy and presence that the act of continuous creation is supposed to establish between God and creatures. A painting or a story does not "live and move and have its being" in the one who fashions it-nor would even a living and thinking creature, if the manner of its making were solely that of an artisan. These shortcomings raise the question of whether we should seek to replace the image of artisan and artifact with one that is more dynamic. We might think of God as like a singer and of what is made as His song, or of God as like a dancer and of what is made as His dance. By envisioning the act of creation as a "doing" rather than a "making," analogies of this type more adequately indicate the continuing ontological dependence ofcreation on Creator. They also draw our attention to a mode of presence radically different from that of one body to another, the presence of an agent "within" his own actions. They may thus bring us closer to what St. Paul presumably has in mind in the passage quoted from Acts. On the other hand, they have faults of their own, for they are hard to reconcile with creaturely freedom and the reality of secondary causation. How could any kind of "doing" act contrary to the will of its doer? Indeed, how could it act at all? Actions are not causal agents; a song does not act in its own right, but is at best an instrument of the one who sings it. So it would seem that, taken to their logical conclusion, analogies such as that of the singer and his song lead to the denial of both creatures' freedom and their causal efficacy. Susan Feagin puts an end to our burbling. Even if one does not always agree with Feagin, it is a singular merit of her book that it points to the (...) problems that need to be addressed in order to offer a passable theory of appreciation. Her book is subtle, considered, and perceptive, and offers an account that is demanding yet informative and helpful.To appreciate a literary work, we are told, is “not merely to recognize that a work has certain properties,” still less that it has a specific value. Rather, it is to [End Page 201] interact with the work in a way that “gets the value out of it,” where “this involves being affectively or emotionally moved” by the fiction (p. 1).The account of appreciation that follows aims first to explain how affective responses to fiction are possible—where this involves describing in a detailed explanatory way, the activity of appreciation and what it necessarily involves. Second, it aims to explain what it is that warrants or justifies an affective response to literature.Although interpretation is related to, perhaps intertwined with, appreciation, Feagin is adamant that the two activities are entirely different. An interpretation is the end-result, the product, of a certain activity, and gives us the meaning of a work or its parts. Appreciation, by contrast, is the successful exercise of an ability—namely that of interacting appropriately with a text—and does not result in any end product (pp. 34–37). Hence the desire to appreciate a novel is the desire to do various things with it, and in the process to exercise an acquired ability, namely that of responding appropriately to it. The crucial thing about this desire, Feagin suggests, is that it does not involve the mental representation of its object: it is not, for instance, the desire to have experiences of a certain sort. It is what she calls a “no-rep desire” (pp. 51–58).One has to wonder about this. When I buy and sit down to read my next Joanna Trollope novel, I do so partly because I have a pretty good idea of the delights that lie in store. In Feagin’s terms, I wish to exercise a certain ability, and interact appropriately with the text, but in this case I desire to do so because of a well-founded idea that I am going to engage with a certain subject matter: with the personal lives of people in traumatic relationships, and with a range of subtle perceptions and observations about human frailties. While perhaps not fully “rep,” this is far from being a no-rep desire; yet it seems wrong to deny that I desire to appreciate the work.In the three chapters that follow, Feagin looks closely at the activities involved in appreciating a work. As we read, our psychological sensitivity to what we read next is changed, and we move into “different mental gears.” Here Feagin emphasizes the slides and shifts, and the repeated reconfigurations that enter into the appreciation of a text (chap. 3). Such cognitive and affective shifts are to some degree automatic, to some degree under the reader’s control, even though we do not formulate intentions to move into them. But either way, they are what Feagin calls sensitivities—that is, a psychological readiness to respond in certain ways to events in the fiction. Crucially, they introduce into appreciation a temporal dimension, since our sensitivities are enhanced or diminished by what precedes them, and this, as we shall shortly see, is of considerable significance when deciding whether our affective responses to a work are warranted.These mental shifts and slides are required for an empathetic engagement with fictional characters. Feagin’s approach here is largely based on contemporary work in the philosophy of mind and philosophical psychology. Is morality rational? In this book Gauthier argues that moral principles are principles of rational choice. He proposes a principle whereby choice is made on an agreed basis of cooperation, rather than according to what would give an individual the greatest expectation of value. He shows that such a principle not only ensures mutual benefit and fairness, thus satisfying the standards of morality, but also that each person may actually expect greater utility by adhering to morality, even though the choice (...) did not have that end primarily in view. In resolving what may appear to be a paradox, the author establishes morals on the firm foundation of reason. Gauthier's argument includes an account of value, linking it to preference and utility; a discussion of the curcumstances in which morality is unnecessary; and an application of morals by agreement to relations between peoples at different levels of development and different generations. David Gauthier is one of the most outstanding and influential philosophers working in moral theory today, and his book Morals by Agreement has established him as a preeminent defender of contractarian moral theory. This volume brings together a selection of his best essays on contractarianism, many of which have become difficult to find.

Here a group of philosophers, economists and political theorists discuss the work of David Gauthier, which seeks to show that rational individuals would accept certain moral constraints on their choices. The principle of alternate possibilities (PAP), making the ability to do otherwise a necessary condition for moral responsibility, is supposed by Harry Frankfurt, John Fischer, and others to succumb to a peculiar kind of counterexample. The paper reviews the main problems with the counterexample that have surfaced over the years, and shows how most can be addressed within the terms of the current debate. But one problem seems ineliminable: because Frankfurt''s example relies on a counterfactual intervener to preclude alternatives to (...) the person''s action, it is not possible for it to preclude all alternatives (intervention that is contingent upon a trigger cannot bring it about that the trigger never occurred). This makes it possible for the determined PAPist to maintain that some pre-intervention deviation is always available to ground moral responsibility. In reply, the critic of PAP can examine all the candidate deviations and argue their irrelevance to moral responsibility (a daunting prospect); or the critic can dispense with counterfactual intervention altogether. The paper pursues the second of these strategies, developing three examples of noncounterfactual intervention in which (i) the agent has no alternatives (and a fortiori no morally relevant alternatives), yet (ii) there is just as much reason to think that the agent is morally responsible as there was in Frankfurt''s original example. The new counterexamples do suffer from one liability, but this is insufficient in the end to repair PAP''s conceptual connection between moral responsibility and alternate possibilities. (shrink)

The Logic of Leviathan The Moral and Political Theory of Thomas Hobbes.

The Sociosexual Orientation Inventory (SOI; Simpson & Gangestad 1991) is a self-report measure of individual differences in human mating strategies. Low SOI scores signify that a person is sociosexually restricted, or follows a more monogamous mating strategy. High SOI scores indicate that an individual is unrestricted, or has a more promiscuous mating strategy. As part of the International Sexuality Description Project (ISDP), the SOI was translated from English into 25 additional languages and administered to a total sample of 14,059 people (...) across 48 nations. Responses to the SOI were used to address four main issues. First, the psychometric properties of the SOI were examined in cross-cultural perspective. The SOI possessed adequate reliability and validity both within and across a diverse range of modern cultures. Second, theories concerning the systematic distribution of sociosexuality across cultures were evaluated. Both operational sex ratios and reproductively demanding environments related in evolutionary-predicted ways to national levels of sociosexuality. Third, sex differences in sociosexuality were generally large and demonstrated cross-cultural universality across the 48 nations of the ISDP, confirming several evolutionary theories of human mating. Fourth, sex differences in sociosexuality were significantly larger when reproductive environments were demanding but were reduced to more moderate levels in cultures with more political and economic gender equality. Implications for evolutionary and social role theories of human sexuality are discussed. Dramatic events involving dangerous microbes often focus attention on isolation and quarantine as policy instruments. The incident in May-June 2007 involving Andrew Speaker and drug-resistant tuberculosis joins other communicable disease crises that have forced contemplation or actual application of quarantine powers. Implementation of quarantine powers, which encompasses authority for both isolation and quarantine actions, is important not only for the handling of a specific event but also because the use of such authority provides a window on broader issues of public (...) health and the legal rules, ethical principles, and governance systems that support it. Debates about quarantine powers reflect political and social attitudes about public health that often tell us more about this policy endeavor than acts of isolation and quarantine themselves. This symposium issue of the Journal of Law, Medicine & Ethics indicates that interest in public health law in the United States is enjoying a renaissance. The focus of the articles reflects this renaissance, as they explore the state of public health law in various contexts within the United States. Additionally, all but one of the symposium authors plies his or her trade at a university, institution, or government agency in the United States. My task here is different: I focus (...) on public health law within the context of international relations.Analyzing public health law with an international perspective proves no easy assignment. Examining the role of public health law in the proverbial global village takes the analysis out of the familiar territory of law operating within a single sovereign state. The analysis could take two forms. One could compare different national systems of public health law on specific issues. Such a comparative law approach would be interested in, for example, how the public health laws of the United States and South Africa differ in connection with regulating tobacco consumption. One strategy in recent discussions of theological fatalism is to draw on Harry Frankfurt’s famous counterexamples to the principle of alternate possibilities (PAP) to defend human freedom from divine foreknowledge. For those who endorse this line, “Frankfurt counterexamples” are supposed to show that PAP is false, and this conclusion is then extended to the foreknowledge case. This makes it critical to determine whether Frankfurt counterexamples perform as advertised, an issue recently debated in this journal via a pair of articles by (...) David Widerker and John Martin Fischer. I suggest that this debate can be avoided: divine foreknowledge is itself aparadigmatic counterexample to PAP, requiring no support from suspect Frankfurt counterexamples. (shrink)

The World Health Assembly adopted the new International Health Regulations on May 23, 2005. The new IHR represent the culmination of a decade-long revision process and an historic development for international law and public health. The new IHR appear at a moment when public health, security, and democracy have become intertwined, addressed at the highest levels of government. The United Nations Secretary-General Kofi Annan, for example, identified IHR revision as a priority for moving humanity toward “larger freedom.” This article analyzes (...) the new IHR and their implications for global health and security in the 21st century.The WHA instructed the WHO Director-General to revise the IHR in 1995 because the Regulations did not provide an effective framework for addressing the international spread of disease. Doubts about the IHR's effectiveness had, however, been present long before 1995. The critiques identified the narrow scope of the regulations, the lack of compliance by states, and the absence of a strategy for responding to rapid changes in public health's global economic and technological environments. Dramatic changes or revolutions in a field of science are often made by outsiders or 'trespassers,' who are not limited by the established, 'expert' approaches. Each essay in this diverse collection shows the fruits of intellectual trespassing and poaching among fields such as economics, Kantian ethics, Platonic philosophy, category theory, double-entry accounting, arbitrage, algebraic logic, series-parallel duality, and financial arithmetic.

The incident in May-June 2007 involving a U.S. citizen traveling internationally while infected with drug-resistant tuberculosis involved the U.S. federal government's application of its quarantine and isolation powers. The incident and the isolation order raised numerous important issues for public health governance, law, and ethics. This article explores many of these issues by examining how the exercise of quarantine powers provides a powerful lens through which to understand how societies respond to and attempt to govern threats posed by dangerous, contagious (...) pathogens. The article considers historical aspects of governmental power to quarantine and isolate individuals and groups; analyzes the current state of quarantine and isolation law in the United States in light of the recent incident with drug-resistant tuberculosis; and explores global aspects of public health governance and law highlighted by this incident. This paper seeks to rehabilitate St. Augustine’s widely dismissed response to the alleged incompatibility of divine foreknowledge and free will. This requires taking a fresh look at his analysis in On Free Choice of the Will, and arguing its relevance to the current debate. Along the way, mistaken interpretations of Augustine are rebutted, his real solution is developed and defended, a reason for his not anticipating Boethius’s a temporalist solution is suggested, a favorable comparison with Ockham is made, rival solutions (...) are rejected, and the aporetic nature of the problem is explained. The computational genomics community has come increasingly to rely on the methodology of creating annotations of scientific literature using terms from controlled structured vocabularies such as the Gene Ontology (GO). We here address the question of what such annotations signify and of how they are created by working biologists. Our goal is to promote a better understanding of how the results of experiments are captured in annotations in the hope that this will lead to better representations of biological reality through (...) both the annotation process and ontology development, and in more informed use of the GO resources by experimental scientists. The purpose of this article is threefold: to examine the elements of an artful apology; to sequence them in a comprehensive configuration; and to use the taxonomy for assessing the effect of public apologies. The model identifies seven sequential components of an apology: revelation, recognition, responsiveness, responsibility, remorse, restitution, and reform. Also included in the model are four deflective stratagems: dissociation, diminution, dispersion, and detachment. Analysis focuses on actual offense situations rather than artificial simulated settings. Specifically, the study examines whether (...) seven well-publicized apologies conform to the proposed construct. These public figures include Alec Baldwin, Lloyd Blankfein, Jamie Dimon, Gerald Levin, Iris Robinson, Tiger Woods, and Mark Zuckerberg. The article closes with suggestions to direct future research. This paper examines the interactive effects of apology source and apology components on forgiveness. Results revealed a significant source by component interaction. A remorseful employee apology was more successful than a remorseful CEO apology because consumers felt more empathy for the employee. Furthermore, a compensatory CEO apology was more effective than a compensatory employee apology because CEOs could significantly affect consumer perceptions of justice. No significant differences were found between apology source and the apology component of acknowledging violated rules and (...) norms. (shrink)

ABSTRACTIt is proposed that experts are able to integrate prior contextual knowledge with emergent visual information to make complex predictive judgments about the world around them, often under heightened levels of uncertainty and extreme time constraints. However, limited knowledge exists about the impact of anxiety on the use of such contextual priors when forming our decisions. We provide a novel insight into the combined impact of contextual priors and anxiety on anticipation in soccer. Altogether, 12 expert soccer players were required (...) to predict the actions of an oncoming opponent while viewing life-sized video simulations of 2-versus-2 defensive scenarios. Performance effectiveness and processing efficiency were measured under four conditions: no contextual priors about the action tendencies of the opponent and low anxiety ; no CP and high anxiety ; CP and LA; CP and HA. The provision of contextual priors did not affect processing efficiency, but it improved performance effectiveness... (shrink)
